NH: Republican Gun Confiscation is Still Moving

Gun Confiscation is still moving in the New Hampshire Legislature

My statehouse sources have told me that Gov. Sununu and Senator Bradley are digging in and pushing to enact bipartisan eldercare gun confiscation in the form of SB 677.

SB 677 is essentially the same as HB 696 which Governor Sununu vetoed last year.  There is no need for this.  If the Governor is truly interested in protecting the vulnerable members of society all he needs to do is direct Attorney General MacDonald to enforce R.S.A. 631:8, 631:9 and 631:10.  We don’t need a new law that will enable gun confiscation.

After Mike’s alert was made public, I learned that some partisan politicians are claiming that SB 677 is not gun confiscation, so I asked him to take a second look.  Mike Hammond, who is GOAs Legislative Counsel,  compared SB 677 to New York’s newly enacted gun confiscation law and he created this comparison showing the similarities between the two:

IN GENERAL

NY “RED FLAG” GUN CONFISCATION:  This law allows relatives or government officials to sue to obtain an open-ended restraining order against a gun owner.

SB 677:  This bill allows relatives (or people purporting to act on their behalf) or government officials to sue to obtain an open-ended restraining orders against a gun owner.

EX PARTE ORDERS

NY:  The complainant can obtain a temporary order by filing a simple raw uncorroborated affidavit.

SB 677:  The complainant can obtain a temporary order by filing a simple raw uncorroborated affidavit.

NAMES OF PARTIES

NY:  The complainant can remain anonymous, while information concerning the defendant is mandatory.

AFFECT ON GUN RIGHTS

NY:  The issuance of a “red flag” gun confiscation order will make a defendant a “prohibited person” under federal law for the duration of the order.

SB 677:  The issuance of a restraining order will almost certainly make a defendant a “prohibited person” under federal law (18 U.S.C. 922(g)(4)) for the duration of the order.

REMEDIES

NY:  The list of remedies is inclusive, rather than exclusive.

COSTS

NY:  The defendant must bear the costs of defending his constitutional rights, even if successful.

SB 677, if not drafted by Bloomberg and Giffords, is a copy of their wish list. That should be obvious based upon the fact that perennial gun confiscator, Rep. Renny Cushing is a co-sponsor.  If this were not gun confiscation, I doubt Rep Cushing would be pushing it.

The Senate Judiciary Committee has already conducted a public hearing and they can conduct an Executive Session on this bill at any time.  Please don’t wait, take action today!

Here is what you need to do:

Please contact Governor Sununu and urge him to drop his ill-conceived idea of gun confiscation.  Urge the Governor to reverse course and inform the legislature that he no longer supports SB 677.

Then contact Senate Republican leader Chuck Morse and let him know that if he continues to allow members of his party to push gun confiscation he will likely remain the minority leader.
