ATF to Ban 40,000,000 Firearms

 

Support legislation to remove SBRs and SBSs from the unconstitutional NFA Taxation & Registration

 

Joe Biden is coming for your constituents’ guns, and he’s circumventing your constitutional role as a legislator to do it.

With two proposed rules from the ATF, the Biden Administration is planning:

  • To expand the background check system to cover gun parts
  • To force FFLs to keep gun and gun owner Form 4473 information forever (presently these records are destroyed after 10 years to prevent a registry)
  • To ban 40,000,000 pistols


This is the greatest attack on the Second Amendment since the Assault Weapons Ban of 1994, and you cannot let it go unchecked. 

The Biden ATF would have you believe that there are 40,000,000 “’gangster’ type weapons” in circulation that are “especially dangerous and unusual.” Therefore, they say, we need these illegal short-barreled rifles forcibly registered and taxed or confiscated and destroyed.

But there is no wave of crimes being committed with illegal short-barreled rifles.

And these firearms are commonly owned by millions of law-abiding citizens.

We need to be eliminating these infringements on the rights of law-abiding citizens, not doubling down on bad policy.

Here are three ways gun owners need you to use your elected office to fight back right now.

Step 1: Eliminate National Firearms Act Infringements

 

The ATF is weaponizing the 1934 National Firearms Act (NFA) which mandates gun registration, taxation, and other restrictions for Short-Barreled Rifles (SBRs), Short-Barreled Shotguns (SBSs), and Any Other Weapons (AOWs).

Put simply: these infringements shouldn’t exist.

To restore these rights, gun owners are counting you to remove SBRs, SBSs, and AOWs from the NFA.

Currently, your office should cosponsor Rep. Mann’s Home Defense and Competitive Shooting Act of 2021 to protect SBR owners.

Becoming an original cosponsor for Rep. Duncan’s No Frivolous Applications for Short-Barreled Shotguns (NFA SBS) Act (One Pager) is also a strong defense of SBS owners. This bill will be introduced in the House in early July.

AOW is a catch-all regulatory term which must be deleted in order to protect SBR and SBS owners from rogue regulatory agency actions. A bill to eliminate AOWs from the NFA will be circulated in the near future.

Step 2: Don’t Help the ATF Infringe on the Second Amendment

 

Joe Biden and the ATF just circumvented Congress to take your constituents’ guns.

This extraordinarily unconstitutional action calls for extraordinary reaction.

According to SanctuaryCounties.com, there are “1,930 counties that are protected by a 2A Sanctuary at either the county or state-level.”

And, “[t]his represents 61.39% of all counties in the United States.”

Second Amendment Protection Ordinances (SAPOs) refer to ordinances adopted by some jurisdictions in the United States to prevent the enforcement of certain gun control measures that violate the Second Amendment.

The ordinances typically prevent the expenditure of funds for various gun control proposals, such as gun bans, registration, enforcement of gun background checks, and red flag laws.

Now is the time to enforce these Second Amendment Protection Ordinances!

Write to your state and local officials and encourage them to use or enact SAPOs to protect gun owners from President Biden’s rogue ATF.

Here is a letter that a Texas office could use to ask Governor Abbot to sign and use a SAPO in this way. You can use it as a model to send a letter to urge your own state and local officials to take action.

Step 3: Join the 2nd Amendment Caucus’s APA Comments to ATF

 

Currently the two ATF proposed rules are open for an Administrative Procedures Act public comment period.

Members of Congress can and should participate in these comment periods. Reach out to Rep. Massie’s office and join the Second Amendment Caucus’ APA comments to ATF for both these rules. (As a bonus, you can also offer to cosign their amicus brief in the upcoming NYSRPA v. Corlett.)

Commenting during the Administrative Procedures Act comment period guarantees that a response is required from the ATF for any objections you may raise. As Members of Congress, this is critical. Your legislative power is being usurped. You must speak up!

Your office ought to remind your constituents to comment, as well.
