WY: Wyoming – A Great Bill Dies While Two Good Bills Become Law
Last week, 3 strong GOA-backed Second Amendment bills passed the Wyoming Legislature and were sent to Governor Gordon’s Desk, and we now have a mix of bad and good news to report from the final days of the 2026 Wyoming Legislative Session.
First, the Bad News
Sadly, Governor Mark Gordon vetoed SF0101, Second Amendment Protection Act (SAPA) Amendments, which would have added a civil process to Wyoming’s existing Second Amendment Protection laws that GOA helped pass in 2022.
The 2022 law made the state and local enforcement of federal gun control a crime under Wyoming criminal statutes, and these 2026 Amendments would have also given citizens a clear path to pursue civil lawsuits against Wyoming agencies or departments that cooperate with federal gun control.
In an extreme political maneuver, the Governor completely mischaracterized the written text of the Bill in his veto letter and made sensational and inaccurate claims about the bill hindering the prosecution of criminal activity (Click Here for Gordon’s Letter).
GOA’s Senior Vice President, Erich Pratt, refuted Gordon’s claims in the attached Press Release, and GOA used these talking points to attempt to garner support in the Senate for a veto override (Click Here for Erich Pratt’s Press Release).
Unfortunately, efforts to override the Governor failed in the Wyoming Senate in a 12-18 vote even though the Bill had originally passed the Senate 26-5. Because the Senate failed to override the veto, an override vote was not held in the Wyoming House which had previously voted 40-21 to pass the bill.
It is safe to say that the Wyoming Governor exercised the immense power of the Wyoming Executive Branch to thwart the will of nearly three-quarters of the elected Wyoming Legislature who originally voted to pass SF0101.
We will provide more analysis about what occurred with the Second Amendment Protection Act Amendments in the coming weeks.
Now, Some Good News
Two very strong Second Amendment bills did pass into Wyoming law this week.
HB0096 lowers the minimum age to 18 for concealed carry permits (HB096), making Wyoming the 29th state to allow 18-20 year olds to obtain these permits. Now, Wyoming’s young adults can exercise the same Second Amendment Rights as other adults.
While Wyoming is already a Constitutional Carry state, these permits can be important for granting access to some areas that require a concealed carry permit and for Reciprocity with other states when traveling.
Finally, a third and very important bill, HB0098 became law. This new law increases protections against Red Flag Gun Confiscation Orders by making state and local enforcement of these orders a crime in Wyoming.
Given the extreme Constitutional violations that are inherent with Red Flag Orders, this is a huge win for our Second Amendment Rights that should not be forgotten in the wake of the previously mentioned veto of SF0101.
While we lost the SAPA Amendments battle in the 2026 Wyoming Legislative Session, it is important to remember the historic Second Amendment wins that have occurred in Wyoming over the last 5 Legislative Sessions.
Over the last 5 Sessions, GOA has worked to pass some of America’s best Second Amendment legislation including the removal of Gun-Free Zones in schools and most government buildings, a Second Amendment Protection Act which includes criminal penalties, prohibitions against local governments having gun control, and strong protections against Red Flag Gun Confiscation Orders.
THESE ARE HISTORIC VICTORIES PLACING WYOMING AMONG THE TOP STATES IN AMERICA FOR SECOND AMENDMENT RIGHTS.
There is much to be proud of in Wyoming, yet we still have work to do to provide civil lawsuit provisions for citizens to seek relief when their Rights are violated.
