Ohio’s 2025 legislative session will end in less than 3 months.
Which means this session is slipping away with ZERO pro-gun wins.
The Second Amendment Preservation Act (SAPA) was shelved last December, and lawmakers have done nothing to advance it in nearly a year. Which means the critical time for action is NOW!
Back in 2023, SAPA was a Republican-backed effort championed by joint sponsors State Rep. Mike Loychik and State Rep. Jean Schmidt. However the bill met fierce and effective opposition, primarily from Ohio’s law enforcement community, including the Ohio Association of Chiefs of Police and various county prosecutors, as well as gun safety advocates like Moms Demand Action.
What we need in Ohio is something similar to Wyoming’s Second Amendment Protection Act, which includes a criminal penalty as a misdemeanor punishable by imprisonment for not more than one year and a fine of not more than $2,000. They also have a civil penalty of $50,000 per violation against the governmental entity. Ohio’s SAPA should model what Wyoming has done and allow for civil penalties, including a waiver of institutional qualified immunity–so that lawsuits can be brought against the department and not just an individual.
SAPA legislation explicitly prohibits the state or any political subdivision from utilizing personnel, financial resources, or state assets to enforce any federal law, rule, or regulation related to firearms that violates the state or U.S. Constitution. This establishes a strict anti-commandeering “firewall” designed to ensure robust state sovereignty and prevent federal overreach against law-abiding gun owners.
Gun rights activists must compel leadership to introduce and pass a clean SAPA bill to block federal overreach. Punishment for enforcing unconstitutional federal laws, or assisting the federal government with enforcement, should include Civil and Criminal Penalties. There are many great examples of SAPA laws around the country.
With complete republican control in Ohio, there is no excuse for the lack of pro-gun wins in 2025, so let your elected officials know you are displeased with their lack of support for the Second Amendment.
