The National Instant Registration Check

As of November 30 of 1998, ALL FIREARMS PURCHASED AT RETAIL are subject to the National Instant Check. This is because the "five years hence" provision of the Brady Act has arrived: the federal Instant Registration Check.

Registration is the gateway to confiscation.


Please read the November 25, 1998 GOA Press Release regarding Brady Part Two. Larry Pratt details what needs to happen next.     President Clinton wants to extend the Brady registration to private sales at gun shows. The BATF asked for GOA's Opinion regarding this unconstitutional proposal.

Posted here are theStudy Findings detailing the the Brady Registration scheme.     On June 2, 1998, GOA issued the following Press Release to announce the completion of our study of the Brady II registration process. The FBI is in open violation of the law.
  
The BATF has released its Proposed Regulations for implementing the National Instant Check required when Brady sunsets in November 1998. You won't believe what is going to happen.     The GOA Comments to the BATF make it clear that these unconstitutional regulations also go beyond what is allowed by statute. The BATF is a rogue agency that is totally out of control.
  
It is actually the FBI that will be responsible for maintaining the NICS database. Here are the proposed FBI Regulations detailing how the system will work.     The implications of the registration system are obvious to anyone who bothers to look at it. The FBI published a Second Set of Regulations to explain away the Privacy Act considerations.
  
The FBI regulations state outright that they will retain records on you for eighteen months. Two bills, H.R. 2721 (Paul, R-TX) and H.R. 3949 (Barr, R-GA) have been introduced to deal with the problems of Brady. GOA sent this Comparison of the Two Bills to Capitol Hill.     H. R. 2721 is a full-blown complete repeal of the entire Brady Instant Registration Check mess. It also repeals the "sporting purposes" test. Read the Text of H.R. 2721.
  
Unaware of exactly what the Brady Act does? You can read the Text Of The Brady Act to see what is mandated by statute. Compare to the BATF's implementation scheme.     The Smith "Anti-Brady" amendment, which passed the Senate 69-31, would undercut the FBI's tax-and-register plans. In a recent newsletter, GOA documented how Instant Check Is A Bad Check.
